News: Victim of auto vs. pedestrian crash sues Bettendorf

BETTENDORF, IA - According to KWQC, a person who was hurt in an auto vs. pedestrian collision that killed two people on the pedestrian path of the I-74 bridge is suing Bettendorf and WHKS & Co for negligence.

A 46-year-old female was driving when she allegedly struck three people on the bike and pedestrian path of I-74 between Bettendorf and Moline at 1:56 a.m. on May 22, 2022.

Following the collision, an 18-year-old male and a 21-year-old male died from their injuries. A 22-year-old male survived the incident.

Authorities arrested the driver and charged her with one count of aggravated DUI causing death or greater bodily harm, two counts of reckless homicide, two counts of aggravated DUI causing death, three counts of failure to stop at the scene of an accident involving death, and three counts of aggravated reckless driving.

The driver pleaded guilty to these charges on July 5, 2022.

The 22-year-old survivor accuses Bettendorf and the designer of the path, WHKS & Co, of negligence by not blocking vehicles from the path's entrance.

The lawsuit, which was filed Monday, claims Bettendorf and WHKS & Co did not include systems to warn drivers that cars were not allowed to enter the path. It also claims WHKS & Co opened the path prior to its completion.
